Lawyer Serves Notice to Mumbai Police for Not Acting Against BJP’s Amit Satam Over Alleged Hate Speech

A city-based lawyer Abid Abbas Sayyed has sent a legal notice to the Mumbai Police Commissioner alleging failure to act against alleged “derogatory and communal remarks” by BJP city chief and MLA Amit Satam, despite his alleged communal statements falling under cognisable offences in the Bharatiya Nyaya Sanhita (BNS) 2023.
The lawyer has listed multiple instances where Satam made communal statements at public events and on social media.
“Kisi Khan ko Mayor banne nahi denge (We will never allow any Khan to become a mayor)" and "Aap jaisi Pakistan ki aulad se hum darte nahi (We are not afraid of sons of Pakistan like you)”, BJP MLA Amit Satam allegedly stated according to the legal notice issued by lawyer Abid Abbas Sayyed.
The notice claimed that these statements are "inflammatory and capable of inciting communal hostility" and "raises questions" about why no FIR was filed by the Mumbai police.
“This invective is not only highly derogatory but also stigmatises an entire community, imputes foreign allegiance, and squarely falls within the statutory definition of hate speech,” said Bombay High Court lawyer Abid Abbas Sayyed in the notice to the Mumbai Police Commissioner.
“Despite the documented evidence and public outrage, no investigation has been initiated by the police and the police’s failure to act in this scenario not only subverts statutory obligations but also undermines the constitutional promise of equality, secularism and the rule of law,” Sayyed said.
The Bombay High Court lawyer demanded that an FIR (first information report) must be immediately filed against Mumbai BJP chief Amit Satam in all cases involving hate speech or communal incitement under the Bharatiya Nyaya Sanhita (BNS) 2023's Section 196 (promoting enmity) and prevention of public hatred.
The legal notice to the Mumbai Police Commissioner was issued after Congress MP Varsha Gaikwad led a Congress delegation and submitted a written complaint to Mumbai police commissioner Deven Bharti on Tuesday (November 25, 2025), urging him to register an FIR against Mumbai BJP chief Amit Satam for “promoting disharmony” and book him under Sections 152, 196 (2), 299, as well as other sections of the Bharatiya Nyaya Sanhita.
Recently, Mumbai BJP chief Amit Satam, had stated that "Mumbai will not tolerate the imposition of a Khan as mayor”, soon after Indian-origin Muslim politician Zohran Mamdani won the New York mayoral polls contesting as an American Democratic Party candidate and sparked off a debate whether Mumbai could get a Muslim mayor, like it happened in New York.
In addition to this, Mumbai BJP chief Amit Satam also supported BJP minister Mangal Prabhat Lodha, when he filed a police complaint against Congress MLA Aslam Shaikh for allegedly threatening to "finish him off and his family".
However, Congress MLA Aslam Shaikh had rejected these allegations saying that Mumbai BJP chief Amit Satam made false accusations against him and claimed that BJP minister Lodha also made false allegations.
Shaikh claimed that the video clip released by the BJP did not show him making any threat against Lodha.
