Will any action be taken in India against 104 Indian deportees from US? Will they be able to go back to America?

US President Donald Trump has taken a tough stand against illegal immigrants and has accelerated the process of deportation. In this episode, on Wednesday afternoon, the US sent 104 Indian immigrants back to India through its military aircraft C-17. Now the question arises whether any legal action will be taken against these immigrants in India. Will there be a police investigation of them, and will they be able to go to America again in the future?

Will the immigrants be able to go back to America again?

According to Dainik Bhaskar's report, experts said that biometric scans of all the immigrant Indians sent back from America have been done. At the same time, now all these immigrants will never be able to go to America in the future. Even if they try to go to America with valid documents, they will not be able to get a visa.

It is worth mentioning that 20 countries of the world including Canada, New Zealand, Australia, Britain follow the visa policy of America. Therefore, these immigrants will not be able to get entry into all these countries.

Will any case be registered against immigrants in India?

Experts said that no case will be registered against these people in India because they have committed a crime in America, not in India. However, he also said that the police will investigate the ways of reaching America and their involvement in any crime in India. He said, "Many of these people may have gone to America from India with a valid tourist visa, but started living there illegally or entered America through a human trafficking gang, in such cases the police will take legal action against those people."

Under which sections can action be taken?

According to experts, four types of legal action are possible against these immigrants who returned to India -

  • Income Tax Act 1961 - If an immigrant had paid a huge amount to a human trafficking gang to go to America illegally, then the Enforcement Directorate (ED) can investigate this matter.
  • Citizenship Act 1955 and Passport Act 1967 - If a person had tampered with his passport to go to America, then legal action can be taken against him.
  • Immigration Act 1983 – If a person reached the US by illegally crossing the Indian border, then a case can be registered against him under this Act.
  • Customs Act 1962 – If an immigrant has illegally sent property abroad while fleeing abroad, then the Customs Department will investigate it.

These 104 Indian immigrants deported by the US will no longer be able to go back to the US or other countries with strict visa rules. Although no case will be registered against them directly in India, their background and ways of reaching the US will be strictly investigated. If evidence is found of their illegal migration or involvement in smuggling gangs, then Indian agencies can take action against them.
