The court has issued a non-bailable warrant against former Governor Phagu Chauhan in the case of occupying another's field, abusing and threatening to kill despite the court's stay order. In this case, the victim Shivpujan Chauhan, resident of Balrampur police station Kotwali, had filed a complaint in the CJM court. According to this Phagu Chauhan had a cold storage next to the land of complainant Shivpujan Chauhan located in Hafizpur.

Phagu Chauhan and Shivkumar Chauhan wanted to occupy Shivpujan Chauhan's land. Then Shivpujan first took a stay order from the Divisional Commissioner Court and later from the Allahabad High Court.

Despite the stay order, on March 9, 2001, Phagu Chauhan and Shivkumar Chauhan, along with the government gunner and other people, got the sugarcane crop harvested from Shivpujan's field and when Shivpujan objected, they abused him and threatened to kill him.

After completing the hearing in this case, the CJM court summoned Phagu Chauhan and Shivkumar Chauhan for trial on 23 July 2001.

Against this summons order, Phagu Chauhan and Shivkumar Chauhan took a stay order from Allahabad High Court. The file continued under stay order for years. When the file became very old, the stay order issued in this case expired due to being old. Meanwhile, the accused Shivkumar Chauhan died.

Judicial Magistrate Court No. 26 Om Shri Chaurasia ordered the issuance of a non-bailable warrant (NBW) against Phagu Chauhan on 16 July 2024. The court has fixed the next date as 27 August.

Senior BJP leader Phagu Chauhan served as the Governor of Meghalaya and Bihar. He was also an MLA of Uttar Pradesh.
